These Booster Terms of Use (“Booster Terms”) govern your access to and use of certain optional add-on features, services, and enhancements that we make available from time to time in connection with the Rask.ai service (each, a “Booster” and collectively, the “Boosters”).
For purposes of these Booster Terms, “Company”, “we”, “our” and “us” mean BRASK INC., as further described in the Terms of Service.
These Booster Terms form part of the “Agreements” that govern your use of Rask.ai, as that term is used in our Terms of Service (“Terms of Service”). Capitalized terms used but not defined in these Booster Terms have the meaning given to them in the Terms of Service.
By enabling, purchasing, or using any Booster, you agree to be bound by these Booster Terms in addition to the Terms of Service and our Privacy Policy.
If you do not agree to these Booster Terms, you may not access or use any Boosters.
1.1 These Booster Terms supplement and are in addition to the Terms of Service. For the avoidance of doubt, Boosters are part of the “Services” and “offerings” made available through our website for purposes of the Terms of Service.
1.2 If there is any conflict between the Terms of Service and these Booster Terms with respect to the Boosters, these Booster Terms will govern solely to the extent of the conflict. In all other respects, the Terms of Service continue to apply in full.
1.3 These Booster Terms apply to any Booster that we designate as such in the Service interface, in your account, or in any accompanying documentation, regardless of whether the Booster is paid or free.
1.4 Notwithstanding anything to the contrary in the Terms of Service, with respect to Boosters:
(a) any refund, credit, or cancellation provisions in the Terms of Service (including any provisions relating to refunds of fees, minutes, or other usage allowances) do not apply to Booster Fees or to any minutes, quotas, or similar allowances provided by a Booster, unless we expressly state otherwise at the time of purchase; and
(b) refunds, credits, and cancellations for Boosters are governed exclusively by these Booster Terms.
For purposes of these Booster Terms:
2.1 “Booster” means any optional or additional module, feature, functionality, capacity, integration, or service that:
(a) is made available by the Company in connection with the Services; and
(b) is identified in the Service interface, in your account, or other documentation as a “booster,” “add-on,” “upgrade,” or similar.
A Booster never works as a standalone service and is only available as an add-on to an active Subscription.
2.2 “Booster Plan” means the specific plan, package, or configuration of a Booster (for example, included features, usage limits, and price).
2.3 “Booster Fees” means the fees (if any) payable by you for access to and use of a Booster, as specified in the Service interface, in your account, or on our pricing pages.
2.4 “Subscription” and “Billing Cycle” have the meanings given to them in the Terms of Service.
2.5 “Booster Billing Period” means the recurring monthly period we use to charge Booster Fees, as described in Section 5.4 below.
2.6 “Booster Billing Date” means the calendar day on which each Booster Billing Period starts, as described in Section 5.4 below.
3.1 You must be eligible to use the Services under the Terms of Service (including the minimum age requirement and any business authorization requirements) in order to use any Booster.
3.2 Unless we state otherwise, access to a Booster requires:
(a) an active account with the Service; and
(b) an active Subscription that permits use of that Booster. If your Subscription is suspended, cancelled, or not in good standing, we may suspend or terminate your access to the relevant Booster without liability.
3.3 We may make Boosters available only in certain regions, languages, account types, or plans. We may also limit the number of Boosters you can enable or the total usage of Boosters on your account.
4.1 You may activate a Booster by:
(a) selecting and enabling the Booster in your account or the Service interface; and
(b) where applicable, completing payment or confirming the Booster Fees shown to you at the time of activation.
4.2 Unless we specify otherwise at the time of activation:
• Each Booster is provided on a monthly Booster Billing Period basis (even if your underlying Subscription is billed annually).
• A Booster will automatically renew for successive monthly Booster Billing Periods on your Booster Billing Date until you cancel it or we suspend or terminate it under these Booster Terms or the Terms of Service.
4.3 You may deactivate a Booster at any time through your account settings or by contacting our support team, subject to any minimum term or usage commitment displayed at the time of activation. Deactivation stops future renewals but does not entitle you to any refund of Booster Fees already paid except to the extent required by applicable law or expressly provided in these Booster Terms.
4.4 We may suspend or terminate your access to any Booster (in whole or in part) immediately if:
• you breach these Booster Terms or the Terms of Service;
• your account is used in a way that we reasonably believe is fraudulent, abusive, or unlawful; or
• continuing to provide the Booster may create security, legal, regulatory, or operational risk for us, our providers, or other users.
Any such suspension or termination does not limit our other rights or remedies under the Terms of Service.
4.5 If your Subscription is cancelled, expires, or is otherwise terminated, your access to all Boosters linked to that Subscription will end at the same time. Booster Fees already charged for the then-current Booster Billing Period are non-refundable unless required by law or expressly stated otherwise.
4.6 If you change your Subscription plan (including an upgrade or downgrade) and a Booster remains available for your new plan, any active Booster will generally continue in effect for the remainder of its then-current Booster Billing Period, and Booster Fees will continue to apply in accordance with Section 5, unless you deactivate the Booster or we suspend or terminate it under these Booster Terms or the Terms of Service.
If, following a change to your Subscription plan, the features provided by a Booster are included in your new Subscription plan or that Booster is no longer available for your new plan, we may automatically deactivate that Booster as of the effective date of your plan change or at the end of the current Booster Billing Period. We will not charge Booster Fees for any subsequent Booster Billing Periods for a Booster that has been deactivated under this Section 4.6. Any Booster Fees already charged for the then-current Booster Billing Period remain non-refundable, except to the extent required by applicable law or expressly provided otherwise in these Booster Terms.
5.1 Booster Fees, if any, will be presented to you at or before activation (for example, in the Service interface or in your account). Unless expressly stated otherwise, Booster Fees are in addition to any fees payable for your base Subscription or other Services.
5.2 Unless we specify another billing arrangement:
• Booster Fees will be charged using the same payment method as your Subscription;
• You authorize us and our payment processors to charge all applicable Booster Fees and related taxes to your designated payment method; and
• Billing, payment, and tax terms in the Terms of Service apply equally to Booster Fees.
5.3 Some Boosters may be billed based on usage (for example, minutes, characters, number of videos, or calls to an API). In that case, we will describe the applicable usage metric and rate at or before activation. We may measure usage using our systems and logs, and our measurements will be deemed conclusive for billing purposes absent manifest error.
5.4
(a) If your Subscription is billed monthly, your Booster Billing Date will normally be the same calendar day as your Subscription billing date. Each Booster Billing Period runs from the Booster Billing Date (inclusive) to the day immediately before the next Booster Billing Date.
(b) If your Subscription is billed annually, we will calculate a notional monthly Booster Billing Date aligned with the calendar day on which your annual Subscription initially started or most recently renewed (for example, if your annual Subscription started on the 10th of a month, your Booster Billing Date will ordinarily be the 10th of each month). Each Booster Billing Period then runs from that Booster Billing Date (inclusive) to the day immediately before the next Booster Billing Date.
(c) We may adjust the Booster Billing Date where necessary due to shorter months or billing system constraints (for example, if a month does not contain the relevant calendar day). Any such adjustment will not shorten the length of a Booster Billing Period below 28 days.
5.5 This Section 5.5 describes how we charge Booster Fees when you activate a Booster part-way through a Booster Billing Period.
(a) If you activate a Booster at any time from your Booster Billing Date through and including the 14th calendar day of that Booster Billing Period:
• you will be charged the full standard monthly Booster Fee for that Booster Billing Period; and
• the same standard monthly Booster Fee will apply to each subsequent Booster Billing Period for that Booster, unless you cancel the Booster or we change the Booster Fees under Section 5.6.
(b) If you activate a Booster after the 14th calendar day of a Booster Billing Period but before the next Booster Billing Date:
• for that initial Booster Billing Period only, you will be charged a discounted introductory Booster Fee equal to fifty-five percent (55%) of the standard monthly Booster Fee (a forty-five percent (45%) discount); and
• from the next Booster Billing Period onwards, the full standard monthly Booster Fee will apply automatically, unless you cancel the Booster or we change the Booster Fees under Section 5.6.
5.6 We may change Booster Fees and pricing structures at any time in accordance with the fee-change provisions in the Terms of Service. Any change to Booster Fees will become effective no earlier than the start of the next Booster Billing Period, and where required we will provide reasonable prior notice so that you may cancel the Booster before the change takes effect.
5.7 Booster Fees are non-refundable. You are not entitled to any refund, credit, or other compensation for any Booster Fees already paid, or for any unused, expired, reduced, or deleted minutes, quotas, or similar usage allowances provided by a Booster, in any circumstances (including cancellation or deactivation of a Booster, cancellation or downgrade of your Subscription, non-use of a Booster, or changes to your account or usage), except to the extent (i) we choose to issue a refund or credit in our sole discretion, or (ii) a refund is required by applicable law. Any minutes, quotas, or similar usage allowances provided by a Booster are not redeemable for cash and may expire, be reduced, or be deleted in accordance with these Booster Terms and any usage rules communicated in the Service interface. Any refunds or credits that we may grant in relation to a Booster are made on a discretionary, one-off basis and do not create any right to future or similar refunds or credits.
6.1 We may offer free or discounted trial access to certain Boosters for a limited period or limited usage. Trial terms, including duration and any usage caps, will be communicated at the time of the offer. Trial minutes, usage, or quotas may expire automatically if not used within the stated period and will not be recoverable.
6.2 We may designate some Boosters (or parts of them) as alpha, beta, experimental, preview, or otherwise not generally available (“Beta Boosters”). Beta Boosters are offered as-is, may be modified, suspended, or discontinued at any time, and may be subject to additional conditions. You understand that Beta Boosters may be less reliable or accurate than generally available features and may not be suitable for production use without your independent review.
6.3 We may include certain Boosters within promotional offers, bundles, or special plans at no additional charge or at a discounted rate for a limited time. We may remove or modify access to such Boosters at the end of the promotional period or upon changes to your Subscription.
7.1 Your use of Boosters must comply with:
• these Booster Terms;
• the Terms of Service, including any usage restrictions, prohibited uses, and security obligations; and
• all applicable laws, regulations, and third-party rights (including intellectual property, privacy, and publicity rights).
7.2 In addition to any prohibited uses in the Terms of Service, you must not, and must not allow any third party to:
a. use any Booster to build or train competing models or services, or to benchmark our Services in a misleading way;
b. circumvent technical or usage limits associated with a Booster;
c. misrepresent Booster outputs as being produced by a human where applicable laws require disclosure of AI-generated content; or
d. use any Booster in a way that creates or disseminates content that is fraudulent, defamatory, hateful, harassing, discriminatory, or otherwise unlawful.
8.1 Some Boosters may integrate, interoperate with, or rely on third-party technologies, models, APIs, or services (collectively, “Third-Party Services”), which may be operated by providers other than the Company. This may include AI model providers, cloud infrastructure, analytics providers, or payment processors.
8.2 Your use of Third-Party Services may be subject to separate terms and conditions between you and the third-party provider. We are not responsible for the content, security, or practices of Third-Party Services and make no warranties about them. To the maximum extent permitted by law, we disclaim all liability arising from your use of any Third-Party Services in connection with a Booster.
8.3 By enabling or using a Booster that relies on Third-Party Services, you authorize us to transmit your Content, Customer Data, and related information to those Third-Party Services as necessary to provide the Booster. Any such use of data is subject both to our Privacy Policy and to the privacy and data-processing practices of the relevant third-party provider.
9.1 Your Content and Customer Data handled in connection with Boosters will be processed in accordance with the same principles that apply to the Services generally under the Terms of Service, our Privacy Policy, and any applicable data-protection policies we publish.
9.2 We may generate and use aggregated, de-identified, or statistical data related to your use of Boosters (“Usage Data”) for purposes including product improvement, analytics, billing, and service optimization, as described in the Terms of Service and our compliance documentation.
9.3 We implement technical and organizational measures designed to protect Content and Customer Data processed via Boosters, consistent with our security and data protection policies, including our Encryption Policy and Data Protection Policy. However, no system is perfectly secure, and we cannot guarantee absolute security.
9.4 You are responsible for ensuring that you have all necessary consents, notices, and lawful bases to submit Content and Customer Data to any Booster (including any personal data or sensitive data), and for the legality of your instructions to us and to any Third-Party Services used by a Booster.
10.1 As between you and the Company, we and our licensors own all rights, title, and interest in and to the Boosters, including all associated software, models, user interfaces, and documentation, together with all improvements, modifications, and derivative works. Your rights to use Boosters are limited to the license granted under the Terms of Service and these Booster Terms.
10.2 Subject to these Booster Terms and the Terms of Service, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Boosters solely in connection with your permitted use of the Services and within any usage limits or plan parameters that apply.
10.3 “Outputs” are content, data, analyses, or other results generated or processed by the Services when you use a Booster (for example, translated or dubbed video, rewritten text, synthetic voice content, transcripts, or analytics). As between you and the Company:
• you retain your existing rights in the Content and Customer Data you provide; and
• subject to your compliance with these Booster Terms and the Terms of Service, you may use Outputs for your lawful purposes, including commercial use, in accordance with applicable law and third-party rights.
10.4 You grant us all rights necessary to host, process, store, transmit, and otherwise use your Content, Customer Data, and Outputs to provide, maintain, secure, and improve the Services and Boosters, as further described in the Terms of Service and our Privacy Policy.
10.5 You are solely responsible for evaluating and reviewing Outputs before relying on them. Boosters, especially those based on AI or machine learning, may generate results that are incomplete, inaccurate, offensive, or otherwise inappropriate.
11.1 Boosters are part of the Services and are provided subject to the same warranty disclaimers as in the Terms of Service. To the maximum extent permitted by law, Boosters and all associated Outputs are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory.
11.2 Without limiting the above, you understand that:
• Outputs generated by AI-based Boosters may not be accurate, complete, or suitable for every use case;
• we do not guarantee that Boosters will detect or prevent all harmful, infringing, or illegal content; and
• you are responsible for implementing appropriate safeguards, human review, and quality control processes based on your risk profile and regulatory environment.
11.3 The limitation-of-liability provisions in the Terms of Service apply fully to your use of Boosters. To the maximum extent permitted by law, our aggregate liability arising out of or relating to any Booster will not exceed the Booster Fees you paid for that Booster in the twelve (12) months preceding the event giving rise to liability, or, if no separate Booster Fee is charged, the total fees paid by you for the Subscription plan that includes the Booster during the same period.
11.4 Nothing in these Booster Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
12.1 You may stop using any Booster at any time by deactivating it in your account or contacting us. Termination of a Booster does not terminate your entire account or Subscription unless you specifically cancel your Subscription in accordance with the Terms of Service.
12.2 We may suspend or terminate your access to Boosters or to the entire Services as described in the Terms of Service, including in cases of breach, unlawful use, or security risk.
12.3 Any provisions of these Booster Terms that by their nature should survive termination (including Sections relating to fees, IP, confidentiality, disclaimers, limitations of liability, dispute resolution, and governing law) will continue in effect after termination.
13.1 We may modify, discontinue, or add features to any Booster at any time, including by introducing new Boosters, changing functionality, or discontinuing existing Boosters. Where required by law, or where changes materially and adversely affect you, we will provide reasonable prior notice.
13.2 We may amend these Booster Terms from time to time by posting an updated version at https://www.rask.ai/ or another location we designate, in line with the amendment process set out in the Terms of Service. Your continued use of any Booster after the updated Booster Terms become effective constitutes your acceptance of the updated Booster Terms.
14.1 These Booster Terms are governed by the same governing law that applies to the Terms of Service.
14.2 Any disputes arising out of or in connection with your use of Boosters will be resolved in accordance with the dispute resolution, arbitration, limitation period, and class-action waiver provisions of the Terms of Service.
15.1 If you and we have signed a separate written agreement that expressly states it supersedes or modifies these Booster Terms with respect to specific Boosters, that separate agreement will control to the extent of any conflict.
15.2 If any provision of these Booster Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, consistent with the severability principle described in the Terms of Service.
15.3 Our failure to enforce any provision of these Booster Terms will not be considered a waiver of that provision or any other provision.
15.4 As between you and us regarding Boosters, these Booster Terms, together with the Terms of Service, Privacy Policy, and any applicable separate written agreement, constitute the entire agreement and supersede any prior agreements or understandings relating specifically to the Boosters.
